对于女车主和4S店双方的讨论没有抓到核心问题，他们一直围绕着“三包”讨论其实是不对的。奔驰车从厂家运到4S店后有一次落地检查，售前还有一个PDI检查，大约包括五大部分，几十项，其中第二大项内容就是检测发动机，必检的一项。作为一个专业的人员，打火就能看到缺机油了，为什么PDI检查没有发现，并且没有告诉女车主，导致女车主做出了错误的意思表示。
王绪坤指出：
这根本不是三包的问题，三包规定是指消费者在使用过程中出现的质量问题，而这辆车根本还没进入使用环节，是在购买环节出现问题，属于合同违约，未向消费者交付合格产品，应该按照合同违约处理。
